Second Amendment: Handgun Bans

Yesterday the Chicago supreme court granted Alan Gura, a constitutional lawyer, the right to address them on their ban of hand guns. Alan Gura also addressed the DC ban on hand guns recently. Both these bans are direct violation of the constitutional right to “bear arms.” Banning hand guns also do not lower gun crime rates. In 1982, a survey of imprisoned criminals found that 34% of them had been “scared off, shot at, wounded or captured by an armed victim.”

In Chicago, murder rates were up over the same time frame last year. The number of homicides from when they past the hand gun ban and now have risen from:

Doesn’t seem all that effective to me?  Washington DC also passed a hand gun ban in 1976. “Between 1976 and 1991, Washington D.C.’s homicide rate rose 200%, while the U.S. rate rose 12%.” Total offenses involving handguns in England have risen since 1997. Crimes involving firearms have more than doubled since the gun ban in 1997 as well. Also in Canada, the “breaking and entering” crime rate rose 25% after the 1977 law preventing handgun use for self defense. As cliche as it seems it is true “guns don’t kill people, people do.” Rather than banning all guns, which is shown not to work, how about more strict penalties for violating gun laws? If a criminal wants to commit a crime with a gun, he is going to get a gun. End of story. Whether he has to buy it on the street or in the store. Not to mention its in direct violation of our constitution. Not only that, but Thomas Jefferson also stressed the importance of gun ownership by citizens. “What country can preserve its liberties if its rulers are not warned from time to time that their people preserve the spirit of resistance? Let them take arms.”  –Thomas Jefferson to William Stephens Smith, 1787.”  James Madison in the Federalist Papers also backs the importance of the second amendment. “To these would be opposed a militia amounting to near half a million of citizens with arms in their hands, officered by men chosen from among themselves, fighting for their common liberties, and united and conducted by governments possessing their affections and confidence.” Madison shows there that the militia, which is often used as an argument against gun control, is chosen by themselves.

Then again, these are just old, obsolete thinkers and the constitution is a living document right? According to President Obama it is.
